TERMS AND CONDITIONS OF VEHICLE HIRE
1. A 50% (Fifty per centum) deposit on receiving the reservation is required to secure a booking which is only valid once funds have been cleared – and the balance is payable at the latest one week before the event. A 5% (five percent) charge will be imposed should any changes be made to a booking (i.e. time, address, etc) within 12 hours before the event. Our refund policy is at the discretion of management who will take all relevant circumstances into account and using the following as a guideline for cancellation fees: 60 days 10% ; 30 days 20% ; 29-22 days 25% ; 21-15 days 30% ; 14-7 days 50% ; 6 days 65% ; 2 days 80% ; 24 hours 100%. Their decision is final and no correspondence will be entered into.
2. The price is inclusive of travel to and from specified locations, and travel and waiting times at each of the specified venues up to a maximum total duration as specified in the quotation, thereafter additional at R500/R275 per hour or part thereof dependant on vehicle booked payable in advance and subject to the availability of the vehicle.
3. Vehicles will not be allowed to travel on dirt roads, except for short dirt or gravel driveways etc.
4. There is a strict no smoking policy, and passengers agree to conduct themselves in a manner befitting the vehicle
5. The client is responsible for guests and assumes full financial responsibility for any damages to vehicle caused by the client or their guests whether by accident, neglect or intent.
6.The Driver and Company are not responsible for articles left in vehicles, any damage or loss incurred, whatsoever the cause and illegal acts committed by the client or their guests during the rental.
7. Red Carpet Rides cannot be responsible for any delays or inconvenience due to Public disturbance, riots etc; Traffic (accidents, road blocks or peak hours); Unfavourable road/or weather conditions; Unforeseen mechanical failures and Situations deemed an “Act of God”.
8. In the event of severe weather conditions or mechanical breakdown the chauffeur may, at his or her sole discretion, discontinue or delay the journey. The use of pre-war (1939 and older) and open top cars is weather dependant. In the event of poor weather conditions on the day of the function we reserve the right to offer an alternative vehicle, or as a last resort if no alternative vehicle is available, to cancel the booking. Should it become necessary to cancel the booking from the business side, the client will receive a full and unconditional refund. Should the journey be discontinued by the chauffeur other than pt.9 below, you will receive a full and unconditional refund. Should the selected car become unavailable due to mechanical breakdown, or for whatever other reason, you will be offered a choice of alternative cars, or a full and unconditional refund.
9. The Driver may terminate the charter at any time, without refund if they deem the party unruly or endangering the safe operation of the vehicle and monies will not be refunded.
10. We reserve the right to substitute alternative vehicles in the event of an occurrence beyond our control.
11. Client assumes full financial responsibilities for all payments due at the end of the charter, including overtime, wait time, gratuity and damage fees. Any damages to our vehicle will be charged for with immediate effect for your account.
12. Any deviation from the original booking details / route will be charged for accordingly and will be covered by the indemnity. The client is responsible to notify us of all airlines changes, delays, cancellations, missed flights, etc. Delayed flights are billed after flight arrival. Excessive wait time will be charged accordingly.
13. No additional passengers are allowed in the vehicle other than what was contracted in the original charter. For the sake of comfort, we transport a maximum of 3/5 passengers, dependant on the vehicle. We do not transport children under the age of six as our cars are not equipped with child seats.
14. Regurgitation fees are R1000 (One Thousand Rand), everything else will be estimated by a professional.
15. Client authorised charges to credit card with/without imprint.
16. Under age passengers please note: No alcohol, drugs, other intoxicants or cigarettes are allowed in the vehicle. The driver may inspect the luggage if necessary. Parents must provide a phone or cell phone number in case of violation or emergency.
17. No one, other than our driver, is permitted to drive the vehicle.
18. Exclusion of Liability – The client and their respective guests shall not have any claim of any nature whatsoever against Red Carpet Rides (the “Company”) for any loss, damage or injury which the client and their guests may directly or indirectly suffer(whether or not such loss, damage or injury is caused through the negligence of the Company or its servants or employees) by reason of any accident in which the vehicle may be involved or theft of the vehicle or theft of any article or item from the vehicle or the vehicle being in a state of disrepair or arising out of any act or omission by the Company or its servants or employees or arising in any manner whatsoever out of the use of the vehicle or the conveyance of the client and his/her co-passengers in the vehicle for any purpose whatsoever or arising as a result of the vehicle being unavailable on the required date for any reason or arising from any other cause whatsoever. The client shall under no circumstances whatsoever have any claim against the Company for consequential loss, howsoever caused. All passengers, guests of the client and the client, who shall sign the indemnity on their behalf, and include under age passengers, are covered and included by means of the client’s signature.
